What Happened
Modern cars use cellular technology for navigation, emergency calls, and connected features. That technology is covered by standard essential patents (SEPs). Patent holders like Nokia and Qualcomm want to license automakers at the vehicle level. Automakers say they should license at the component level—from the chip suppliers.
Why It Matters
The difference is enormous. License per vehicle at $20 each, and an automaker selling 5 million cars pays $100 million. License per chip at $3 each, and they pay $15 million. That's an $85 million difference.
Patent holders say the value of connectivity is in the end product—consumers buy connected cars, not connected chips. Automakers say the auto industry has always licensed at the component level, and their suppliers should handle IP.
A licensing pool called Avanci has signed deals with many major automakers, but some hold out, arguing the rates are unfair and the licensing level is wrong. Litigation is ongoing in multiple countries.
This isn't just about cars. As more industries adopt standardized technology—IoT devices, smart appliances, industrial equipment—the same question arises: who should take the license, and at what level?
What You Should Know
If you're in the automotive supply chain, understand your SEP exposure. Are you licensing from Avanci or directly? Are your suppliers indemnifying you? What happens if you're sued?
If you're a SEP holder, balance enforcement with relationships. Automakers are long-term partners, not one-time defendants. Aggressive tactics may win battles but lose wars.
The industry needs clarity, but courts haven't provided it yet. Until they do, negotiation and pragmatism beat litigation.
